TOWN OF MOUNTAIN
PLANNING COMMISSION   FEBRUARY 5, 2013

MINUTES

The meeting was called to order by Chairman Herman at 7:00 p.m. in the Town Office. Roll call was taken with Hull, Litscher, Lauterborn, Maletzke and Herman present as well as 2 in attendance. The agenda was posted on February 2, 2013. Motion to approve the Agenda by Herman. Seconded by Lauterborn. Motion carried.

Minutes of the Planning Commission meeting January 2, 2013 were available for review. Motion to accept minutes by Maletzke. Seconded by Hull. Motion carried.

Recreational Town Road Usage Application-Berken (continue discussion of possibility of opening All Town Roads for ATV use) – Motion that Planning Commission recommend to the Town Board that all roads in the Town of Mountain be open to ATV use with the exception of the County and State Highways; and that we draft the Ordinance to be as close as possible with the Ordinances that our adjoining Towns have, which would be Doty, Riverview and Lakewood; also that if land owners do not want their roads to be routes that they have the option of following the same procedure as the Town has in place now to open the routes; In other words they would have to petition, fill out the application and jump through all the hoops to be a road opened up – to get it closed by Litscher. Seconded by Herman. Discussion prior to vote in regards to who will draft Ordinance (Town Board or Planning Commission); what happens with Town Roads that dead end at State or County Highways and ability to petition Oconto County for possibility of route access. Litscher amended motion that Planning Commission propose a draft and present it to the Board; and the Board can have a Public Hearing if they want. Seconded by Herman.  Motion carried.   Planning Commission members discussed draft of Ordinance-to use Town of Riverview Ordinance but to add Section VI line H to allow for process for property owners to petition to close Town Roads. Clerk Kauzlaric will type up Draft of Ordinance and forward to Planning Commission Members prior to next months meeting. Tabled until March Planning Commission Meeting to Draft Ordinance to be presented to the Town Board.
