TOWN OF MOUNTAIN
BOARD MEETING    NOVEMBER 8, 2011

MINUTES

The meeting was called to order by Chairman Hull at 7:00 p.m. in the Town Office.  Roll call was taken with all board members present, as well as 8 in attendance.  The agenda was posted on November 5, 2011. Motion to approve the agenda by Uecke.  Seconded by Hull.  Motion carried.  The Pledge of Allegiance is said.

Treasurer’s Report was given by Kauzlaric with bank statements available for review.  Motion to accept Treasurer’s report by Wirth.  Seconded by Uecke.  Motion carried.

Minutes of the Town Board meeting held October 11, 2011 were available for review. Motion to approve minutes by Uecke.  Seconded by Wirth.  Motion carried.

Budget Amendments – none at this time.

Disbursements were available for all to review; check #19722 to and including #19762 for disbursement of $24,434.02, which includes auto withdrawal of payroll taxes; plus check #19763 for late bill received from JNS Enterprises in the amount of $1,800.00 for a total disbursement of $26,234.02.  Motion to approve disbursements by Hull.  Seconded by Wirth.  Motion carried.

Ambulance Report – Chairman Hull stated no meeting/update. No motions are entertained.

Fire Department Report is given by Interim Chief Wirth; couple meetings; 2 fire calls; stated old stock of radios are at Mountain Ambulance garage to be reprogrammed, then will swap out and get current radios reprogrammed.  No motions are entertained.

Humane Officer Report is given by Rzepka, with 13 calls researched; also stated that he has received his recertification for the next 2 years.  No motions are entertained.

Cemetery Report
Establishing grave site opening/closing fees – Sup. Uecke explained other cemeteries charge fees ranging from $100 – $2,500; Cemetery Committee voted for $30 opening/closing fee; Town of Riverview forwarded minutes showing approval of $30 opening/closing fee.  Motion that we charge the $30 opening/closing fees for burials by Uecke.  Seconded by Wirth.  Motion carried.

Planning Commission Report – No meeting.

Communication File is reviewed and list is signed.

McComb Lake Road ATV Route Speed Limit – Chairman Hull stated he spoke with Troy @ Oconto County and Joe Paul @ DNR and both replied that signage for 25 MPH is legally correct; they also stated anyone operating an ATV is to be aware of the 10 MPH law if within 150’ of homes; public comment requested 10 MPH signage to be posted, Chairman Hull stated he could speak with Dusty Trails ATV Club regarding signage, but current signs are legally correct.  No motions are entertained.

Special Gathering License Chute Pond Snowmobile Club (Correction *November 12th) –Clerk Kauzlaric commented that previous application had incorrect date which was not noticed until after the Board Meeting; corrected application received from Chute Pond Snowmobile Club available for review.  Motion to approve by Wirth.  Seconded by Uecke.  Motion carried.

Donation request form Northern Oconto County Substance Abuse Prevention Partnership – Chairman Hull discussed that this request was tabled until 6 Town Board Meeting, which he was unable to attend; Sup. Uecke stated that other towns gave donations of $100 – $200.  Motion that we donate $100 by Wirth.  Seconded by Hull.  Motion carried.

Chute Pond Rehabilitation Dist #1 Donation – Town Board received a $500 donation from Chute Pond Rehabilitation Dist #1 to be used to offset costs associated with Joint Municipal Court System in an effort to regulate Ordinance violations.  Motion to accept donation by Wirth.  Seconded by Uecke.  Motion carried.

Snow Plow Driver New Hire – one new application received from Grader Operator ad was contacted and interested; Clerk Kauzlaric notified board that Christopher had called and stated he was pursuing getting a CDL; Town Board discussed that he would be backup for grader driver; Robby McClain had also expressed interest in assisting with plowing.  Motion to approve hire of Christopher Lindert, pending reference checks by Wirth.  Seconded by Hull.  Motion carried.

2012 Special Assessments – Motion for no Special Assessments for 2012 by Hull.  Seconded by Uecke.  Motion carried.

Fireworks Permit – Clerk Kauzlaric received a form received from City of Gillett; board members discussed some changes to form to specify “professional” fireworks displays.  Tabled until next meeting.

Outdoor Event Permit – Chairman Hull reviewed Ordinance sample received from Gary Pemrich, Gillett Chief of Police, which was obtained from a larger city/village; board members to review document and changes for items that may not pertain to our town, then will have a lawyer review before final approval; Town Board looking to have Ordinance in place by March; Chairman also stated Oconto County Sheriff is looking at noise issue and may have suggestion for time limits to match their enforcement.  Tabled until next month.

Concealed Carry – No Weapons Allowed Signage – Town Board reviewed information printed from WTA website; discussed Town Office/Shop compared to Community Center; also discussed looking at Employee Handbook regarding employee’s exceptions for knives, which are used for work purposes; board will review need for signage at Community Center at a later date.  Motion to put No Weapons sign on Town Office/Garage building by Uecke.  Seconded by Hull.  Motion carried.

Resolution #05-2011 Adopting Employee Grievance Procedure – Clerk Kauzlaric provided information from WTA website and need for Grievance Procedures for discharged employees; Resolution and Grievance Procedure and forms came from samples on WTA website; Clerk Kauzlaric had contacted Atty. Leege; also Atty. Bartels from Stellpflug Law Office in Lakewood regarding possibility of becoming “Hearing Officer”, which needs to be someone other than a Town employee; Town Board discussed reviewing other options for Hearing Officer and price to be set.  Motion that we accept the Resolution #05-2011 with the only contingent on finding the proper mediator and the price will be determined at that time by Hull.  Seconded by Wirth.  Motion carried.

Hearing of the People brought about concerns relating to correct verbiage for future donation check from Chute Pond Protection & Rehabilitation Dist #1; Robby questioned if he was hired for plow driver; question if snow plow drivers are required to have CDL; question of what used ice rink was purchased for and where it will be located.
